How Is Child Support Calculated in West Virginia?
The amount of child support a non-custodial parent pays is determined by the West Virginia Child Support Guidelines.
The guidelines take the following factors into consideration:
- The total gross monthly income of both parents
- The number of children
- Any special needs of the child
- Any childcare expenses
- Any additional expenses, such as medical
Once the guideline amount is determined, the court may make adjustments to the guideline amount based on certain circumstances. For example, the court may make an adjustment if the non-custodial parent can prove that he/she is unable to pay the guideline amount. Additionally, the court may also make an adjustment if the custodial parent does not work or makes significantly less money than the non-custodial parent.
When Does Child Support End in West Virginia?
In West Virginia, child support payments must continue until the child reaches the age of 18. However, if the child is still enrolled in high school, the payments must continue until the child turns 19 or graduates, whichever occurs first.
If the child is disabled, the child support order may be extended up to age 21. The court may also order that the child support payments continue until the child is no longer enrolled in school.
